1) The dwelling known as ‘Atlantic Pines’ (“The Property”) is offered for Holiday Rental subject to confirmation by Wayne Adams (“The Owner”) to the renter (“The Client”). 

2) To reserve property the Party Leader (The Client) should complete the Booking Form and return it, together, with the non-refundable Booking Deposit (£250 per week).  Following the receipt of the Booking Form and Booking Deposit, The Owner will send a confirmation invoice. This is formal acceptance of the booking. We will reserve the dates booked in good faith, but they will not be confirmed until we have received the Booking Form and the Booking Deposit in cleared funds.

The party leader must be over 25 years of age. The completion of the Booking Form indicates acceptance of the Booking and Payment Procedure/Terms and Conditions by The Client and that they have the authority to act on behalf of the persons named on the booking form including any substitutions or additions by any subsequent agreed amendments to the booking.

Please note we do not accept bookings from stag or hen groups or parties.

Bank Account details will be provided with the Booking Form for you to make the transfer.

3) Balance Payment, together with Security Deposit (see Clause 4) is payable not less than eight (8) weeks before the start of the rental period. If payment is not received by the due date The Owner reserves the right to give notice, in writing, that the reservation is cancelled.

Reservations made within twelve weeks of the start of the rental period require full payment at the time of booking. 

4) Refundable Security Deposit of £500 is required in case of damage to the property or contents. However, the sum reserved by this clause shall not limit The Client’s liability to The Owner and The Client is solely responsible for any and all damages, stains or breakage(s) that may be caused to the property or its contents and also for any non-return or loss of keys or loss of items in the inventory during their stay. 

The Property is inspected both before and at the end of each rental period. 

The Owner will account to The Client for the Security Deposit and refund any balance due within two weeks of the end of the rental period.

5) Amendments / Cancelation by The Client: Amendments to or cancellation of a booking by The Client will be subject to the following conditions.

(i) Changes to Dates: In the event that you would like to change the dates of your booking, we will endeavour to accommodate you without any additional administration charges. Changes to dates in higher tariff periods will be subject to the higher rental charge. Changes to dates in lower tariff periods made within 8 (eight) weeks of the start of the rental period, will only be subject to the lower charge if we can re-let the initial higher tariff period.

(ii) Cancellation Policy: 

  • up to 8 weeks before the start of the rental period: no additional charge. Non-refundable Booking Deposit applies. See (2).
  • 4-8 weeks before the start of the rental period: 50% refund of the total rent.
  • 2-4 weeks before the start of the rental period:  25% refund of the total rent.
  • less than 2 weeks before the start of the rental period: no refund

Covid 19 Update – Notwithstanding the foregoing, if the rental cannot take place due to a government lock down covering the area of The Property or the address of The Client on the date of travel or a government mandated prohibition of international travel, then The Client can rebook for a future date. Refunds will be provided if the future date is a lower cost or The Client will be liable for any additional cost if the future date is a higher cost. There will be no administration charge. The same will apply if The Client would need to quarantine in either location, but the requirement of a negative test to travel shall not be considered a valid reason to move the booking and any payment due will still apply. We strongly suggest that you arrange suitable travel insurance. 

(iii) Early Departure: It should be noted that once the property has been occupied, should The Client decide to vacate the property before the end of the rental period no refund will be due.

6) Amendments / Cancelation by The Owner: We do not expect to have to make any changes to your booking. However, problems can occur that would result in us having to make an alteration or, very occasionally, cancel a booking. If this does happen, we will contact you as soon as is reasonably practical and inform you of the cancellation or the change to your booking. If it is necessary to cancel your booking we will refund the balance of any money you have paid us.

7) The Client is strongly advised to arrange comprehensive travel insurance (including cancellation cover) and have full cover for the party’s personal belongings, public liability, medical expenses etc. Since these are not covered by The Owners insurance. It is recommended that all travellers should apply for and carry an EHIC (European Health Insurance Card) or a GHIC (Global Health Insurance Card). 

8) The rental periods shall commence at 17:30 on the first day and finish at 10:00 on the last day. The Owner shall not be obliged to offer the accommodation before the time stated and The Client shall not be entitled to remain in occupation after the time stated.

9) The maximum number of people to reside in property must not exceed the number of guests listed in the Booking Form and in no circumstances exceed 7 in total. 

10) The Client agrees to be a considerate tenant and to take good care of

the property and to leave it in a clean and tidy condition at the end of the rental period. The Owner reserves the right to make a retention from the Security Deposit to cover any damage or additional cleaning costs if The Client leaves the property in an unacceptable condition.

11) The Client shall report to The Local Manager (Mr Brooks), without delay, any defects or breakdown in equipment, plant, machinery, appliances, pool or any of the facilities in the property, so that arrangements for repair or replacement can be made as soon as possible.

12) The Owner shall not be liable to The Client:

(i) for any temporary defect or stoppage in the supply of public services to the property, nor in respect of any equipment, plant, machinery, appliances, pool or any of the facilities in the property.

(ii) for any loss, damage or inconvenience caused to or suffered by the Client if the Property shall be destroyed or substantially damaged before the start of the Rental Period and in any such event, The Owner shall, within seven days of notification to the Client, refund to the Client all sums previously paid in respect of the Rental period. Under no circumstances shall The Owners’ liability to The Client exceed the amount paid to The Owner for the rental period.

(iii) for any direct or indirect damages that may arise as a consequence of the use by The Client of The Property, including without limitation, damages, losses because of fires, theft, robbery or criminal behaviour. 

(iv) for any loss, damage or injury which is as a result of adverse weather conditions, riot, war, strikes, acts of god or other matters beyond The Owners control. 

13) No pets allowed on the premises under any circumstance. 

14) Smoking is strictly prohibited within the house. Additional cleaning costs will be charged to The Client if The Property requires additional cleaning due to smoke damage.

15) Upon arrival at The Property, The Client and all members of your party must take time to familiarise yourselves with the location, layout, and depth of the swimming pool. Please take note of any pool warning signs, depth markings and other instructions for use, which may be displayed.

The Client must make sure that all members of the party are familiar with the pool protection. The Client is fully responsible for ensuring that the legally required security cover is in place at all times when the pool is not in use. 

Children must be supervised at all times, especially around the swimming pool. 

Children must be monitored while being close to the swimming pool or while swimming. Children who cannot swim must wear appropriate flotation equipment.

Diving is forbidden due to the depth and width of the pool.

16) The Client agrees to allow The Owner and their agents access to the property at all reasonable times for the purposes of maintenance, repair or inspection.

17) In the event of any infringement of the aforementioned obligations, The Owners at their sole discretion will be entitled to request The Client to leave the property and The Client shall have no right to claim any type of compensation.
